1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of chicatelier-store.myshopify.com and any related pages, content, and services (together, the "Site"), and your purchase of any products from us.

The Site is operated by [Luck Unlimited, LLC], trading as Chic Atelier Store ("we", "us", "our").

By browsing the Site or placing an order, you agree to these Terms. If you do not agree to them, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state or country of residence, to place an order. By ordering, you confirm that you meet this requirement and that the payment method you use belongs to you or that you are authorised to use it.

3. Your Account

You may place an order as a guest or by creating an account. If you create an account, you are responsible for keeping your password confidential and for all activity that occurs under it. Please notify us promptly if you believe your account has been accessed without your authorisation.

We may suspend or close an account that we reasonably believe has been used in breach of these Terms.

4. Products and Descriptions

We describe our products as accurately as we can, including fabric composition, measurements, and construction details supplied to us by our manufacturing partners.

Please note the following:

  • Color. Screens vary. The color you see on your device may differ slightly from the item as it arrives.
  • Measurements. Garment measurements are taken by hand and may vary by up to 3 cm. Where a size chart is provided, please measure against it rather than relying on a size label alone.
  • Materials. Where an item is made from a synthetic material such as PU, polyester, nylon, or microfibre, we describe it as such. We do not describe synthetic materials as leather without qualifying the term.
  • Availability. All products are offered subject to availability. We may add, withdraw, or discontinue any product at any time.

5. Pricing

All prices are listed in US dollars (USD) and are exclusive of any applicable sales tax, which is calculated at checkout where required.

We take care to price accurately, but errors occur. If we discover that an item has been listed at a materially incorrect price after you have ordered, we will contact you before dispatch and offer you the choice of proceeding at the correct price or cancelling for a full refund. We will not charge you the higher price without your agreement.

Prices may change at any time. A change will not affect an order we have already accepted.

6. Orders and Acceptance

Your order is an offer to buy. Our acknowledgement email confirms that we have received it; it does not constitute acceptance.

A contract is formed only when we dispatch the item and send you a shipping confirmation.

We may decline or cancel an order, in whole or in part, where:

  • the item is unavailable or has been mispriced;
  • we are unable to verify the billing or delivery information provided;
  • the order appears fraudulent, or is placed in breach of these Terms;
  • we are unable to ship to the delivery address given.

If we cancel an order you have already paid for, you will receive a full refund.

7. Payment

Payment is taken at checkout through Shopify's secure payment processing. We do not receive, store, or have access to your full card details.

By submitting payment information, you confirm that you are entitled to use the payment method concerned.

8. Shipping and Delivery

We ship throughout the United States. Orders are processed promptly, and most deliveries arrive within 7 to 14 business days of dispatch.

Delivery estimates are estimates, not guarantees. Carrier delays, weather, and customs processing can extend them.

If we have not dispatched your order within 30 days of the date you placed it, you may cancel for a full refund at any time before dispatch by emailing us. We will also contact you proactively if we become aware of a significant delay, and you may cancel at that point.

Risk of loss passes to you on delivery to the address you provided. Please check your address carefully at checkout — we cannot redirect a parcel once it has been dispatched.

9. Returns and Refunds

We do not require returns. If you are not satisfied with your purchase, you are entitled to a full refund and you keep the item.

Our Return & Refund Policy sets out the process, timeframes, and conditions in full, and forms part of these Terms.

10. Intellectual Property

All content on the Site — including text, product descriptions, photographs, graphics, page layouts, and the Chic Atelier name and branding — is owned by us or used under licence, and is protected by copyright, trade mark, and other intellectual property laws.

You may view and print content for your own personal, non-commercial use. You may not copy, reproduce, republish, scrape, or use our content for commercial purposes without our prior written permission.

11. Acceptable Use

You agree not to:

  • use the Site for any unlawful purpose, or in breach of any applicable law or regulation;
  • attempt to gain unauthorised access to the Site, its servers, or any connected system;
  • introduce any virus, malicious code, or automated process that interferes with the Site's normal operation;
  • collect or harvest data from the Site by automated means, including scraping product data or pricing;
  • impersonate any person, or misrepresent your affiliation with any person or organisation;
  • resell products purchased from us as new or as authorised Chic Atelier stock without our written agreement.

We may suspend or terminate your access to the Site for any breach of this section.

12. Reviews and Submissions

If you submit a review, comment, photograph, or other content to us or to the Site, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with our business, including in marketing.

You confirm that any content you submit is your own, is accurate, and does not infringe anyone else's rights. We may edit or remove content that is unlawful, offensive, or misleading, but we are under no obligation to monitor submissions.

13. Third-Party Services and Links

The Site runs on Shopify and uses third-party services for payment processing, analytics, and advertising. Your use of those services is governed by their own terms and privacy policies.

The Site may contain links to third-party websites. We do not control them and are not responsible for their content, products, or practices.

14. Disclaimers

The Site is provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, except where such warranties cannot be excluded under applicable law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

15. Limitation of Liability

To the fullest extent permitted by law, our total liability to you arising out of or in connection with any order, whether in contract, tort, or otherwise, is limited to the amount you paid for the products giving rise to the claim.

We are not liable for indirect, incidental, special, or consequential losses, including loss of profit, loss of opportunity, or loss of data.

16. Indemnity

You agree to indemnify us against any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of [NY], United States, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in [Westchester, NY].

If you have a problem with an order, please contact us first. Most issues are resolved quickly and without formality.

18. Changes to These Terms

We may update these Terms from time to time. The version published on the Site at the moment you place an order is the version that applies to that order. We will update the "Last updated" date above whenever a change is made.

19. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.

Our failure to enforce any provision is not a waiver of our right to do so later.

These Terms, together with our Return & Refund Policy and Privacy Policy, form the entire agreement between you and us in relation to your use of the Site.
